I chalk it to bad writing because I think it's pathetic that he's a scroll all of a sudden.

That conversation that he and Fury had in the second episode. While both Don Cheadle and Samuel L. Jackson did a fantastic job with that scene, it didn't seem like it was the real Rhodey. And then you had his voice on the other end of the phone call that Varra made in episode three. You will get some answers by the end of the series.
