I postulated the theory a few years ago that Emily created Yay, and I probably wasn't even the first one. But as yet, it's never been confirmed.
But I don't agree with the rest of your theory. I think Yay is principled against mind-meddling simply because they would hate it if anyone did it to them (as if anyone could, but in theory...). The mind is the single place where you are *you* - for anyone, but especially for an AI, since they can swap bodies. So to tamper with one's mind is to tamper with their very essence.
As for "Emily like she is today", that's precisely *how* she would be able to create an AI like Yay. Emily's done stuff in relatively recent past that attracted the attention of the government. She doesn't even try - she just has a gift.

I haven’t read all the comments, so I’m sorry if this has already been discussed, but I have a theory:
Emily created Yay.
We know that Emily has more potential than we are shown. We know that she has had government intervention before. We know that Yay trusts her. Yay has an *EXTREME* aversion to messing with peoples minds, suggesting that they have done it in the past with less than stellar results. We also know that Yay is terrified of being discovered by the government and being dissected.
I think Emily made Yay, along with some other ‘interesting’ items/programs, and that attracted the attention of the government. The government then attempted to do something bad to either Yay or Emily (or both), and Yay retaliated. In order to protect Emily, she wiped the incident from all parties minds, but was rushed and made a mistake. Thus we got Emily like she is today.

Yay doesn't like half-measures quite probably because any half-assed work would be a great blow to their pride. Given their resources, going for half-measures takes more self-control than going all out (like in a situation with Roko and giving away their money).
Even more interesting, that drive to make everything in their sphere of interest more secure, improved and controlled is a sign of possible childhood trauma in humans - I wonder if we would ever get a glimpse into something like Yay's childhood?

Aurelia seems happy about it, but I'd be pissed if someone started "improving" my setup without asking first. I'm sure Yay's changes are improvements from a strictly technical perspective. But unless I'm mistaken, Aurelia previously had a system that she had set up herself, understood, and could troubleshoot if it broke, and now she doesn't have that anymore.
It would fine if they had offered and waited for consent before acting, especially if they'd offered to show the details of what they were doing so that Aurelia could understand her new system. Maybe that's not practical because it's too advanced, but if so, that's all the more reason to ask for permission.

It couldn't possibly be either, because being either would make it a God rather than an AI. Lacking godhood, it's closeness to omniscience is limited by its access to sensors. It chooses to limit what it accesses, but even at max "power" it can't know what it can't see/hear/read about. The contents of a room with no electrical sensors in a cave that know one brings sensors into would remain a mystery to it until someone shares that info in some way that Yay could access...
