crash out of the century

i am losing my mind for real so let me go off for a second

everyone knows i've been talking about for like a year how i started commissioning artists and a live2d model right? so. that person is fucking me over so bad. i commissioned them 8 months ago, and all i've gotten is the sketch i showed you guys, and i'm obviously fucking fed up right??? i use the money you guys give me to make better content, but some of it has basically been stolen from me.

not only have i asked them for updates and they were like yeah i don't have any, but they've posted about needing money and being broke, going out, going on trips, spending money, going on vacation, etc, and not only that, but REDEBUTING, having a subathon, and working on their own model. when i asked for the refund btw they rejected it and said they didn't have the money. mind you, i'm not their only client, i believe they have at least 3 to 5 clients backlogged. almost $3k. and they don't have the money NOR the product to deliver.

they told me they were confused why i wanted a refund and i should've waited because in their tos there is "delays because of life and school". should i have waited the full year? until you were ready? until you were done with school???? after they said that, they offered to get it done in 5 days, suddenly, out of the blue. then, when i said "if you can manage it", they said they MIGHT have the color done by the end of the week.

here's the thing, i've done commissions, i have compassion, i understand that life happens, but you cannot do this to people. above all, you took commissions, took money, spent that money, and now are saying you don't have any money at all. you don't have the product to deliver, you're acting oblivious, and i'm not the only one you're doing this to! and now i'm the bad guy and you're confused and annoyed. the turnaround for model art is 3 months, average. i was willing to give them 2 more because they were going through something, but they worked on the sketch immediately, and then fell off working on it.

i am beyond angry and pissed off, and i don't even want to use the model. i don't know what i'd use it for. i don't want to use a model from someone who can't commit to their work, one that stole money essentially, and didn't have the gall to understand that they couldn't take the work. now my debut has been held back, and i have to still deal with them while they harass ME while they finally finish it, and i'm going to go to a different person who can both draw and rig my model. however, that puts me out of $600 on just the art. i'm beyond angry. i just want to hurry and move past this and debut and make content again.

I hate how people go “refer to my TOS” and think that it absolves them of something like this. Services aren’t being rendered! It doesn’t matter what the TOS says at that point, they aren’t holding up their end of the bargain. I hate the whole “people are too litigious” angle but the mere threat of legal action is often enough, although you have to be willing to initiate proceedings and most people can’t. If they’re any form of legal savvy they might cut contact then and there. Try to pursue a chargeback or shame them on your public socials with receipts.

when i say chargeback through your bank you would probably have to see about a fraud complaint, idk how it actually works but i've heard of people managing to get their money ack even later than a year at times.

This is the reason why every time i see a post like this i make a point of saying Chargeback at the 6 month mark no matter the circumstances. If even 1 person sees me comment that and saves themselves money then good but alas it's always too late for the post im commenting on, there might be a chance you can chargeback through your actual bank and i would definitely recommend trying to. Artists need to be held accountable. Too many scammers out there.
