It can be argued that whilst offloading the glasses to persue 'Intense Muscle God' (IMG), the Defendant acted with omission. In this situation, he had a duty to act, to communicate that the glasses are to be connected to the Claimant during requested footage with IMG. In contrast to this, it is argued that the Claimant acted with recklessness when taking footage of the Defendant with IMG. •These breaches of duty were the proximate cause of the glasses being in harm's way. • An injury occurred to the glasses. Injury does not just mean 'to break', this can mean any harm. In this instance falling, scuffing, mild tension and mental harm for fear of being crushed have been taken into account on behalf of the glasses. • In this situation parties are to split damages 50-50%. Both receive demerits or no one receives them. And perhaps invest in a leather glasses attachment to both parties outfits. • HOWEVER! There is a strong argument for Volenti non fit injuria, meaning that MrK's glasses, through the act of just being MrKs glasses, are willing knowingly and voluntarily risking danger.
