Yeah they have the same eye Kashi and Obito but there's a difference. Kashi is a normal ninja while Obito is an Uchiha. Obito said it when was fighting Konan. Manny tried to incorporate and use Uchiha power for themselves like Danzo did with Izanagi. And Obito said those justsu are not as powerful and are even considered fake because they are not performed by an Uchiha. They may have the same eye but Kashi is not Uchiha that's why it takes such a toll on Kashi using his eye cuz he is not compatible with the Sharingan. And that's why Itachi called it a fake Sharingan not to mock Kashi but rather meaning that Kakashi can't never use his Sharingan at full 100% like an Uchiha could. And that's why Kakashi can't pass thru things like Obito.
