August Minipod: What is the State of Election-Related Misinformation?

On this month’s minipod episode, Lawfare Associate Editor for Communications Anna Hickey was joined by Lawfare Senior Editor Quinta Jurecic to discuss what the outlook is regarding efforts to prevent election-related disinformation in the run up to the 2024 election, including the recent hack of the Trump campaign by Iranian-backed actors. The Utah Legislature is planning to undermine the powers of, and pack Utah’s Supreme Court because this month the Court decided in favor of “the people” in a gerrymandering case. The case limited the 2/3 Republican majority legislature from being able to throw out Citizens Initiatives after the citizens-initiated law was passed by a statewide majority. The Court interpreted the Utah Constitution to say that the citizens have the right “to reform their government” using ballot initiatives - because that is what it says. To undo the decision, the Legislature called themselves into an “emergency session” and voted to put an amendment on the Nov ballot. They are manipulating the language to ensure they regain the power to throw out ballot initiatives. Now they are also using derogatory descriptions of our Supreme Court (5 unelected people) and threatening to impose term limits and more scrutiny in the nominating process - which Utah already has a requirement for a nominating committee but also Senate confirmation. These 5 justices were nominated by our Republican Gov and confirmed by our 2/3 majority Republican Senate. But now they are being punished by the legislature for being too independent. We citizens of Utah would appreciate any help fighting for our Constitutional rights and Supreme Court support.
