先日、Stability AI社より、同社が提供するAIモデルおよび関連サービスに関する利用規約の改定が発表されました。この新規約は2025年7月31日付で施行されます。

今回の改定において、特に注目すべき点は、画像生成AI「Stable Diffusion」などを含む同社製品に関し、性的表現を含むコンテンツの生成が全面的に禁止されることが明示されたことです。

原文抜粋：
“We Prohibit Sexually Explicit Content.
This includes using Stability Technology to facilitate:
・non-consensual intimate imagery (NCII)
・illegal pornographic content
・content relating to sexual intercourse, sexual acts, or sexual violence.”

これにより、性交・性行為の描写、性的暴力、非合意の親密な画像（NCII）などに関わるコンテンツの生成が禁止対象となります。

■ 現在使用しているローカルモデルについて

私が主に使用しているのは、Stability AI社のSDXLをベースとしたローカル派生モデルです。これらのモデルは7月31日以前に公開されたオープンウェイトモデルであり、ローカル環境での使用に関しては、現時点で新規約の影響は及ばないと認識しています。

また、SDXLモデルは「Open RAIL++-M」ライセンスの下で提供されており、以下のように取り消し不能な著作権ライセンスが明記されています。

『第3条 著作権ライセンスの付与：
本ライセンスの条項および条件に従い、各貢献者は、あなたに対して、補完資料、モデル、およびモデルの派生物を複製、作成、公開展示、公開実演、サブライセンス、および配布するための、永続的、全世界的、非独占的、無料、ロイヤリティフリー、取消不能な著作権ライセンスをここに付与します。』

このため、モデル公開当時のライセンス条件に基づく使用については、後の規約改定によって遡及的に制限されることはありません。

■ 今後の投稿方針について

結論として、現状の投稿方法（ローカルモデルでの画像生成）に直接的な影響はないと判断しております。ただし、今後以下のような点には注意が必要です。

• PixivやPatreonなど利用プラットフォーム側の規制強化の可能性

• AI生成コンテンツ全体に対する社会的・倫理的な監視の強まり

• 各プラットフォームの利用規約変更に伴う投稿制限や削除リスク

これらの状況を踏まえ、7月31日以降の動向によっては、一時的に投稿を控えるなど、慎重な対応を取る可能性があります。その際は、事前にご案内いたしますので、何卒ご理解のほどお願い申し上げます。
