2024-11-22 15:00:34 +0000 UTCIn case you were wondering why YouTube is so annoying about this, fair use isn't some standard you can follow to know when a thing isn't copywrite infringement. It's a standard you can use as a legal defense when someone sues you for copywrite infringement. This means that you can't just say X is fair use because fair use is decided on a case-by-case basis. Until the case actually goes to court, the most you can say is "this should fall under fair use." That's why YouTube sides with copywrite holders by default even if you would probably win in court. Until the court battle actually happens, it's not officially fair use and YouTube is putting themselves at risk by continuing to host the content.
